3.1 Context

My web development services include, but are not limited to, the following:

3.2 Quotation

I will discuss your requirements and then document these in an email, including, if required, a payment schedule. The quote is valid for 30 days from the date sent. If you wish to proceed with the quote after the 30 days have elapsed, the existing quote will need to be reviewed and potentially amended before acceptance; costs may differ from the original quote.

Please note that some work may be provided as a recurring service with a periodic payment (e.g., monthly). Prices for such services are subject to change and may be reviewed from time to time.

Any requirements not documented will not be delivered and therefore need to be discussed and quoted as new work at a later date.

Any time frames communicated to you at any time should be considered estimates only.

3.3 Contract

Your agreement for the commencement of work constitutes a legally binding contract between us.

3.4 Duration

The contract commences on the date of agreement and shall continue:

  • For one-off projects, until full payment has been received and all agreed deliverables completed; and
  • For recurring services, on an ongoing basis subject to periodic payments, until terminated by either party in accordance with the agreed cancellation terms.

3.5 Cancellation

If you wish to cancel the work, then you can do so via email. No refunds of payments already made from you to me will be provided under any circumstances, and the work completed to the point of cancellation will not be delivered.

I reserve the right to cancel the work at any time for any circumstance. At my discretion, I may deliver the work completed to the point of cancellation; however, the work delivered should be considered unfinished and untested.

3.6 Refunds

I do not offer refunds.

3.7 Delivery and Installation

The work will be delivered on an agreed date, confirmed near the end of the work.

Prior to this you should thoroughly test the work on a staging/development environment, including all aspects of your website and potential data volumes, even if not directly related to the functionality the work provides.

Once the work is delivered, it is deemed completed to a satisfactory standard, and no additional support will be provided. If you require additional support at a later date, this would need to be discussed and quoted as new work.

Where appropriate, I can provide installation of the work onto your website; this may incur an additional charge.

I do not keep any form of backup of your work, so it is recommended you keep a backup.

3.8 Compatibility

I will ensure compatibility with devices and browsers using the latest software versions only at the time the work commences. Devices and browsers outside this scope are not supported.

I cannot guarantee compatibility with other software. If compatibility with any other software was stated during quotation, the compatibility should be considered exploratory, with no guarantee it will be achievable.

If you find any form of incompatibility issue at a later date that requires rectifying where feasible, this would need to be discussed and quoted as new work.

Please note that when performing maintenance or related tasks, software updates or third-party changes may introduce new issues or incompatibilities. While reasonable care will be taken, I am not responsible for any such issues, and any rectification required will be treated as new work.

3.9 Content

You are responsible for all content within the work. I accept no responsibility for any dispute arising from content used, such as written content, stock media, etc.

To my best knowledge, all material I use is free for commercial use with no attribution required. It is recommended you supply your own materials for my use and have professional indemnity insurance that covers intellectual property/copyright infringement.

3.10 Communication

I do not guarantee availability for ad hoc or unscheduled communication. If communication becomes excessive, such as repeated calls, extended discussions, or frequent unscheduled requests that interfere with work progress, I reserve the right to invoice for this time.

3.11 Redistribution

You are not permitted to redistribute the work, in full or in part.

3.12 Liability

The work is provided ‘as is’, and I will not be liable to you for any loss, damage, miscommunication, or expense (including loss of profit, business, or goodwill, etc.) arising from any issue encountered, and I shall have no liability to pay any money to you by way of compensation.


4. Projects

4.1 Context

My projects include, but are not limited to, the following:

4.2 License

The applicable license for the project is contained within the source code.

4.3 Usage

I do not recommend installing or updating my projects on a production website until you have thoroughly tested that it is compatible with all aspects of your website in a staging/development environment.

4.4 Content

To my best knowledge, all material I use is free for commercial use with no attribution required. It is recommended you have professional indemnity insurance that covers intellectual property/copyright infringement.

4.5 Paid functionality

If a payment is required, such as a premium upgrade, additional terms and conditions will apply; ensure these are read before purchase.

4.6 Promotional

Some projects may offer the option to receive promotional emails. You can opt out at any time by using the unsubscribe link at the bottom of those emails.

4.7 Third parties

Some projects may include third-party components, such as license management. In these cases, I recommend reviewing the privacy policies of the relevant third parties before using them.

4.8 Liability

I will not be liable to you for any loss, damage, miscommunication, or expense (including loss of profit, business, or goodwill, etc.) arising from any issue encountered, and I shall have no liability to pay any money to you by way of compensation.
